 　　本文之研究目的在於檢視國內當前之性罪犯社區處遇制度，以明瞭現行制度面與實務運作是否存有若干盲點與缺失、是否足以影響性罪犯的處遇成效以及再犯預防的終極目標，以及在相關法制規範修正後是否已確實改善了這些缺點，抑或仍然有其不周全之處。筆者以實務運作面所遭遇到的問題為出發點，對照現行法律的規定，並尋求外國制度作為他山之石，進而對現行法制規範提出檢討與建議，企盼能提醒政府當局徹底檢討實務面與制度面的嚴重落差，以落實性罪犯的再犯預防，從而建構一個適合於國內性罪犯的社區處遇制度，創造一個對婦幼人身安全更為理想的生活環境。
 

　　在第一章的緒論部分，本文首先分析當前國內性罪犯社區處遇所發生的問題，說明自己的研究背景及動機，並介紹相關文獻對於該議題的見解，同時將研究的範疇加以界定，並建構整個研究的架構。
 

      在第二章則首先說明我國現行性侵害犯罪加害人之社區處遇模式及相關問題。本文寫作過程中因經歷法律變更，故本章的討論將會區分說明性侵害犯罪防治法修法前、後的實務運作現況，以及其相關問題。
 

      第三章為國外制度的介紹。針對前面章節所發現的問題，本文以國外對於性罪犯處遇著有成效的國家為對象，探討其所採納之相關制度的內涵及其具體作法，例如：美國梅根法案（性罪犯的登記與公告制度）、佛蒙特州的鑽石處遇模式，以及德國的社區監控措施，目的在於藉由國外制度的介紹，討論該等制度的優缺點，以評估是否適於作為我國建立性罪犯社區處遇措施的參考。
 

      第四章為綜合討論。在分析國內所面臨的問題與介紹國外的制度之後，本章探討今後我國在性罪犯的社區處遇方面，應有的改革方向。包括國外制度值得做為借鏡的具體作法、觀護制度的改革、科技設備的其他措施的運用，及性罪犯的再犯研究。本文並不建議將國外制度完全植入我國，反倒是將其做部份的修改，以期能取其優點且充分適合於國內環境。而有關觀護制度的改革，及性罪犯的再犯研究，由於長期以來被忽略，而這二個議題是本文認為欲建立一個周全的性罪犯社區處遇制度，最重要的區塊之二。
 

      第五章為結論與建議，本文彙整第四章的討論等，簡要地提出綜合性的見解與結論，期以拋磚引玉之舉，促發更多討論與研究。本文呼籲社會除了應重視加害人的再犯問題，採納相關的預防措施之外，也應重視加害人的更生問題（如：就業、家庭等），如此方能根本解決性侵害加害人對社會所帶來的危險。

● ​English Abstract:

      The research purpose of this text lies in inspecting the place of domestic and present sex offender's community treatment system, in order to understand whether there are several blind spots with practice operation with lack the current  regulations , the enough influencing offender's place to meet the effect and recommit the ultimate goal prevented, and has already really improved these shortcomings after the relevant legal system norm is revised, or still have its place not thorough. I regard questions met practice operation as the starting point, contrast the regulation of the current law, and seek the foreign system as the stones from other hills , and then propose making a self-criticism and suggestion on the current legal system norm, hope can remind the serious drop that the government make a self-criticism the practice and the system completely , in order to carry out relapse prevention of sex offender, thus build and construct a suitable for the domestic sex offender’community treatment system, create a living environment even more ideal to personal security of women and children.
      In the introduction part of chapter one, this text analyses at first that meets the question happened in the present domestic of offender's community treatment, prove that one's own research background and motive , and introduce the relevant opinion on this topic of document, define the category studied at the same time , and build the structure of constructing the whole research.
      Prove in the second rule and regulation at first that meets the way and relevant question in the community treatment of the current infringement crime inflictor in our country. Goes through the legal change in the writing course of this text, so copy discussion of chapter distinguish person who prove infringement crime prevent and cure law practice operation present situation to build law, and its relevant problem.
      Chapter three the introduction to the foreign system. To the question that the front chapter finds, this text is meeting the effective country to sex offender's place as the target with foreign countries, probe into the intension of its relevant systems adopted and concrete practice, for example: Meet the way in the diamond places of American plum root bill (the registration and notification system of the sex offender) , Vermont State, and the community of Germany controls the measure, the purpose lies in with the introduction to the system of foreign countries, discuss the pluses and minuses of these systems whether are suitable for in order to assess as the setting up reference of meeting the measure offender's community treatment in our country.
      Chapter four in order to discuss synthetically. After analysing the domestic problem faced and recommending the foreign system, this chapter will be probed into in the future our country will meet the respect , due reform direction in the sex offender's community treatment . Including the foreign system is worth protecting the reform of the system , application of scientific and technological equipment other measures for the concrete practice , temple that are drawn lessons from , and the recommitting of sex offender is studied. This text does not propose totally plants the foreign system into our countrying , though do some modification of it , expect to fetch its advantage and fully suitable for the domestic environment. And relevant views protect the reform of the system, the recommitting of and sex offender is studied, neglected for a long time, and these two topics are that this text think that want to set up the place of a thorough sex offender's community treatment system, second of most important block .
      Chapter five conclusion and suggestion, this text gathers together discussion of the whole chapter four ,etc., putting forward comprehensive opinion and conclusion briefly, one is with act of casting a brick to attract jade, inspire and discuss and study more. This text appeals for the society except should pay attention to the inflictor's question of recommitting , it adopt outside the precautionary measureses when it is relevant,too it should have paid attention to by regeneration issued of inflictor (for instance: Employment , family ,etc.), the can solve at all soing inflictor's danger brought toward society of infringement.
