　　電子監控，利用科技的輔助，不但有利於預防犯罪，更可促進受監控人的再社會化，因而受到世界各國的重視。實施電子監控的依據源於 2005 年的《性侵害犯罪防治法》迄今已有 7 年之久，相關法規雖於 2011 年作出修正，但在實務的運作上，仍存有許多問題。由於電子監控主要由觀護人負責執行，因此本文希望透過深度訪談的方式，瞭解實務運行的問題，同時輔以外國法的比較，探究可解決的方案。首先，在執行電子監控的基本思維中，包含電子監控並非萬能、電子監控標籤化的疑慮以及使用者付費的可行性等問題，都必須加以釐清。其次，現行電子監控的執行上，發生諸多問題。例如，儀器訊號的不穩定、觀護人與個案間信任關係的摩擦、安置機構無法整合及第三代電子監控試行期間過短等，皆在實務的運作上產生不小的困擾。最後，本文提出電子監控立法方式的選擇及監控中心的設置兩項議題，作為解決電子監控難題的芻議。

● English Abstract:

By the use of technology assisted, electronic monitoring not only prevents crime, but also promotes rehabilitation. It has been paid much attention all over world. Basing on the Sexual Assault Crime Prevention Act 2005, the electronic monitoring system has brought into force for seven years in Taiwan. Although the related rules have been amended in 2011, it still remains a numbers of practical difficult positions nowadays. Being responsible for the enforcement of the electronic monitoring, it is essential to deep interview the probation officers, by interviewing of whom the difficulties resulting from the practice can be understood. Furthermore, by way of the comparison with other countries' laws, the solutions for awkward situations can be approached. First of all, several basic conceptions must be clarified, such as the electronic monitoring being by no means omnipotent, the doubt of labeling, and the feasibility of user-pays etc. Next, there are many problems in the electronic monitoring practice. For example, the instrument signal is not always stable; the trust friction between the probation officers and the objects monitored may occur; to integrate the placement agencies it is difficult and the trial period of the third generation of electronic monitoring is too short. Finally, the legislative approaching options and the establishment of the monitoring control center will be addressed and resolved.
