修復式正義工作模式的本土性建構與校園衝突事件之應用

臺灣於2010年引入並推動修復式正義,目標在於讓衝突事件最直接的關係人,提供談論並表達感受的機會,來修補因為這個衝突事件所造成的傷害。修復式正義應用於司法程序具體以柔性司法的面貌處理犯罪事件,透過被害人加害人調解的程序,讓司法案件最直接的關係人,像是加害者、被害者、雙方家屬以及關係人,提供談論這個事件並表達感受的對話平台,來修補所造成的傷害。首先,相關工作模式已經廣泛應用在司法領域,實務工作者亦累積了相當的本土經驗,希望能更臻成熟,並建構契合於社會需求的本土化模式。其次,修復式司法有效減降再犯率,尤其是運用在青少年犯罪議題。修復式正義應用在司法以外,也受到教育領域的重視,特別是用以解決校園衝突事件及霸凌行為,被視為是一種有效的方法之一。修復式正義也對學生的同理心教育有實質的幫助,甚至於可應用解決社區的衝突傷害、企業的人際衝突、醫療糾紛等。在校園衝突事件中,修復式正義的理念與應用已經受到關注,並嘗試引入一些具體的操作方法。本研究擬採質性研究方法,訪談實務工作者,針對工作模式的應用、反思和本土化的建構進行實徵性的探究;進一步地,能將修復式正義應用於校園,並期針對校園衝突問題提供具體有效的策略。

Taiwan introduced and promoted restorative justice in 2010. The goal is to allow the people most directly involved in the conflict to provide opportunities to talk and express feelings to repair the damage caused by the conflict. Restorative justice is applied in judicial procedures to specifically deal with crimes with the appearance of flexible justice. Through the working procedures of victim-offender mediation, the most directly related persons in judicial cases, such as the perpetrators, victims, relatives of both parties and related parties, provide a dialogue platform that talks about the incident and expresses feelings to repair the damage caused.First, relevant work models have been widely used in the judicial field, and practitioners have accumulated considerable local experience, hoping to become more mature and build a localized model that meets social needs.Secondly, restorative justice effectively reduces the recidivism rate, especially when it comes to juvenile delinquency. The application of restorative justice outside of the judiciary has also been valued in the education field, especially to resolve campus conflicts and bullying, which is regarded as one of the effective methods. Restorative justice can also help students with empathy education, and can even be applied to solve conflict injuries in communities, interpersonal conflicts in enterprises, and medical disputes. In the campus conflict incident, the concept and application of restorative justice have been concerned, and some concrete operation methods have been tried to introduce.This study intends to adopt qualitative research methods, interview practitioners, and conduct exploratory investigations on the application, reflection, and localization of the work model. Further, it can apply restorative justice to campuses and provide specific and effective strategies for campus conflicts.
