COVID—19肆虐全球，近期台灣社會發生多起因疫情期間的相關防疫措施所導致的暴力危害事件。尤以超商店員勸導消費者配戴口罩所引發職場肢體暴力事件為甚。為維護綜合商品零售業勞工之職場工作安全，立法委員賴香伶爰於立法院社會福利及衛生環境委員會提案要求勞動部勞動及職業安全衛生研究所(下稱本所)，研究如何防範綜合商品零售業勞工免於職場暴力等不法侵害之具體策略。本所接獲指示後，旋即成立專案小組，並邀請中正大學犯罪防治學系之楊特聘教授士隆、許教授華孚、黃博士候選人光甫、高雄科技大學資訊工程系之林教授威成及陳教授洳瑾等共同組成研究團隊，從暴力犯罪相關學理以及情境犯罪預防理論著手，了解暴力犯罪的成因與預防具體措施，更蒐集各國相關的職場暴力防範作為研討改進的依據外，又因涉及內政部警政署之犯罪防治、法務部之被害人保護及勞動部之職場安全等權管，另於111年12月24日及同年12月27日分別邀請法務部、內政部警政署及勞動部職業安全衛生署等行政機關及法官、檢察官、警察局長、警察大學黃俊能教授等各領域之專家學者召開諮詢會議，期透過各種不同面向之討論，周全研議具體策略。本研究共提出四項具體策略，包括一、研擬「綜合商品零售業職場肢體暴力防範方案」，期以確保綜合商品零售業勞工之職場安全。二、綜整「綜合商品零售業職場肢體暴力防範技術手冊」，參據前揭諮詢會議之專家意見，研擬淺顯易懂及具體之技術手冊供事業單位參考。三、開發「綜合商品零售業勞工安全管理影像辨識系統」，引進國外刑事案件防禦空間之概念，開發具警示功能之影像辨識技術。四、提出「建議意見」，期在犯罪防治、被害人保護及職場安全等面向，提出具體有效之精進意見。

● 英文摘要：

COVID-19 is raging around the world and recently there have been many violent incidents in Taiwan due to the preventive measures taken during the outbreak. In particular, The workplace violence was triggered by supermarket staffs advising consumers to wear masks. In order to protect the workplace safety in the general merchandise retail industry, Legislator Lai Hsiang-ling has proposed to the Social Welfare and Health Environment Committee of the Legislative Yuan to request the Institute of Labor and Occupational Safety and Health, Ministry of Labor to research specific preventive strategies of workplace violence. After receiving the instruction, we immediately assemble a team which its members included Professor Shih-Lung Yang, Professor Huafu Hsu, and Dr. Kuang-Fu Huang from the Department of Crime Prevention and Control of National Chung Cheng University, Professor Wei-Cheng Lin and Professor Jin Shih-Jin Chen from the Department of Information Engineering of Kaohsiung University of Science and Technology to grasp the causes of violent crimes and specific measures for prevention, starting from violent crimes and situational crime prevention theories. In addition, the research team invited the judges, prosecutors, police chiefs, police officers and other experts and scholars to participate consultative meetings with the goal of thoroughly discussing specific strategies through various discussions on December 24, 2021 and December 27, 2021. This study proposes four specific strategies, including 1. Develop "Workplace Physical Violence Prevention Project for the General Merchandise Retailing Industry" to ensure the workplace safety of workers. 2. Consolidate the "Technical Manual for Preventing Workplace Physical Violence in the General Merchandise Retailing Industry" and develop an understandable and specific technical manual based on the opinions of experts at the previous consultation meeting. 3. Develop the "Integrated Merchandise Retailing Labor Safety Management Image Recognition System", introducing the concept of defensive space and developing image recognition technology with warning functions. 4. Propose "specific suggestions" to provide concrete and effective methods for crime prevention, victim protection, and workplace safety.
