自政府開放大陸探親以來，在兩岸交流互動日趨頻密與科技發展日新月異條件下，由於兩岸政治問題未決，而事務性協商機制迄今仍停滯不前，雖曾簽訂金門協議，但卻未進一步建立兩岸共同打擊犯罪的合作機制，如建立有效的「對口單位」聯繫管道、犯罪資訊交換機制、相互協助調查蒐集證據、加強兩岸執法人員交流等，致使無法就兩岸互動衍生的相關治安問題，循正式機制以及制度化管道尋求解決之道，導致區域犯罪問題處於灰色地帶。進一步促使犯罪份子利用兩岸雙邊法制規範、執法目標及其能力與成效仍有相當落差等因素，進而共同從事犯罪活動。這種情況若無法有效防制或遏止，長此以往，對我國社會治安產生極大負面影響。隨著兩岸加入WTO 的到來，兩岸交流勢必更趨頻密，未來涉及兩岸的社會治安問題將顯著遞增、多元化與複雜化。兩岸間的犯罪分子亦可能逐漸形成「策略聯盟」(strategic alliance)的共犯共構結構網絡，使社會治安問題更加嚴峻。尤其是在兩岸特殊情勢，以及中共迄未放棄武力犯台前提下，兩岸交流衍生的治安問題，不僅攸關我國社會治安、經濟發展、政治安定，更影響我國家安全，成為綜合性安全與非傳統性安全威脅的重要課題。因此，我方實有必要建構綜合性安全概念，整合運用國家整體能量，與各國進行跨國合作，建構犯罪防制機制，期能有效因應傳統與非傳統性安全威脅。
● 英文摘要：
Since the government lifted restrictions on family visits to the Mainland in 1987, the exchange has become more frequent, with increasing crime problems. The regional crime becomes a source of crime in our country. In the future, the crime events and types between the two sides of the Strait will further increase and diversify. Criminal groups can move across the two sides and form a strategic alliance. The regional crime problems will be much more severe and complicated. Therefore, the regional crime prevention and correction not only influences individual security, social tranquility, economic development, and political stability, but also threatens the security of the nation. In addition to the establishment of crime-lighting mechanism for the regional crime prevention and correction, crime prevention mechanism should be emphasized. This research attempts to use the new institutionalism approach as methodology. Analysis will emphasize macro and micro aspects, including culture, institution, and rational choice. There will be four major study areas. First, crimes of the cross-strait exchange and the cause of the regional crime will be analyzed. The second is to establish crime-fighting mechanism for the two sides. The third is to establish models for regional crime prevention mechanism. The fourth area is aimed to evaluate models for crime prevention and correction.
