創制法律的目的之一即在於保護人們權益以及與社會秩序的安定，然而要是人們對於法律適用的對象產生疑慮時法律是否仍能達成其目的？近年社會矚目案件當中，有一件案件即是轉讓毒品案件，而其法院判決卻是以藥事法的轉讓偽藥罪加以審判，不由得讓人滿腹疑問，為何眾所周知的毒品案件會以適用藥事法而非毒品危害防制條例？毒品與藥品之間又有何不同？實務作法是否有其道理？
我國現行主要與藥物、毒品相關法律為毒品危害防制條例、藥事法以及管制藥品管理條例，因此本文將擷取數個實務上判決加以檢視問題所在，並探討上述法律的沿革背景，透過爬梳其中的脈絡了解其各所欲保護的法益為何，再以學理上之競合理論檢視實務見解中所謂的法條競合是否合理，期冀藉由如此分析研究，了解毒品危害防制條例與藥事法之犯罪競合該如何評價，進而針對我國毒品及藥物犯罪管制體系提出問題與建議，供作參考，盼望能對社會作出些微貢獻。

英文摘要：

One of the purposes of creating a law is to protect people''s rights and the stability of social order. However, if people have doubts about the object of law application, can the law still achieve its purpose? In recent years, one of the public eye-catching cases is the drug transferring cases, and the court''s judgment is based on the Pharmaceutical Affairs Act ''s transfer of counterfeit drugs. It is not enough to make people wonder why the well-known drug cases will be subject to the Pharmaceutical Affairs Act. Not the Narcotics Hazard Prevention Act? What is the difference between narcotics and medicine? Does the practice have any reason?
Current laws related to narcotics and medicine are Narcotics Hazard Prevention Act, Pharmaceutical Affairs Act and Controlled Drugs Act. Therefore, this article will take several practical judgments to examine the problem and explore the evolution of the above laws. Firstly, this article combined the context of the matter to understand the legal benefits of each of the various protections, and then used the theoretical theory of concurrence to examine whether the so-called legal competition in the substantive views is reasonable, and then use this analysis to understand the drug hazard prevention regulations and the drug law. Finally, this article made the proposals for the method of evaluating the crimes and competitions, and then raised questions and suggestions for narcotics and medicine crime control system for reference, and hopedto make some small contributions to society.
