處置高中職校園性侵害、性騷擾事件之挑戰:性別事件非專業調查人員經驗

本研究主要透過性別事件非專業調查人員處置校園性侵害、性騷擾事件經驗,探討目前高中職學校處理校園性侵害、性騷擾事件所面臨的困境與挑戰。 研究者首先探討相關文獻,再擬定半結構式訪談大綱進行深度訪談,並以主題分析法進行訪談資料分析。本研究以性別事件非專業調查人員之性別平等教育委員為訪談對象,共訪問七位,其中四位曾參與校園性侵害、性騷擾事件調查工作。本研究發現如下: 一、性別事件非專業調查人員具備校園性侵害、性騷擾事件處理機制基礎知能 二、性別事件非專業調查人員對於校園性侵害、性騷擾事件相關法規及調查知能尚待加強 三、擔任性平委員面臨重重挑戰 四、實務現場對於通報仍存有諸多疑義 五、法規對於處置性平事件的相關人員與疑似行為人具有較親近關係時,並無具體規範 六、性平事件調查小組組成遭遇嚴峻考驗,且其專業程度需更加提升 七、協助處置性平事件勞心勞力,卻未有相對的福利 八、性平事件懲處令人傷腦筋,尤其是教職員工部分,且性平會對於懲處執行也未妥善把關 最後,根據研究結果提出建議,以供教育單位及未來研究之參考。

This study aims to probe into the experience of the non-professional investigators of sexual incidents dealing with the sexual assault and sexual harassment issue on campus. In addition, it also discusses the difficulties and challenges that high schools encountered nowadays when it comes to the sexual assault and sexual harassment. In the beginning, the researcher reviewed the related literature. Then, the researcher conducted an in-depth and half-structured interview, used thematic analysis to analyze the data. The participants interviewed were seven non-professional investigators of sexual incidents. And four of them once took part in the investigation of sexual assault and sexual harassment on campus. This study found: A.The non-professional investigators of sexual incidents have the basic knowledge in dealing with the sexual assault and sexual harassment on campus. B.The non-professional investigators of sexual incidents have to improve their knowledge about law regulations and how to conduct investigations in sexual assault and sexual harassment. C.The members of gender equity education committee face a lot of challenges. D.The forefront teachers and administrative staff still have doubts about notifying sexual incidents. E.There are no specific law regulations when the person who dealt with sexual incidents had close relationship with the suspected offenders. F.There are lots of challenges encountered by the investigation team, and the professional requirements of investigation team need to be upgraded. G.The person who spares lots of efforts in dealing with sexual doesn’t get reasonable repayment. H.It’ s troublesome and very difficult to deal with punishment related to school teachers and the staff.The execution of the punishment conducted by the gender equity education committee needs to be improved. Eventually, the researcher proposes some suggestions for educational organizations and future study.
