性侵害被害人於司法程序之保護-以新竹地區為例<P>Protection of Sexual Assault Victims in Criminal Procedure –The Example of Hsinchu.

This thesis focuses upon adult women that became victims of Sexual Assault: how does protection for these women realize within criminal procedure. Following this question, this research is based on the Hsinchu area. Since it is standing policy to enhance and emphasize sexual assault victim's interests, the thesis will ask, whether related protection policies are fully implemented. On the side of the victim, the current institutional set-up is centered around sexual assault prevention centers, with judicial proceedings spindling aroung this center. The institutional network that is supposed to work as a team includes medical institutions, police, social workers and procuratorial organs; in accordance with normative changes of the Crime Victims Protection Act, victims may even apply for crime victim compensation, a fact that shows how even the economic security of related crime victims is taken into official consideration. Therefore this research scrutinizes how protective goals are achieved and expectations of victims are met by the team assisting the victim; the timeframe starts with the very onset of a case and spans to the point where the judicial process is brought to an end. Are there difficulties with applications for economic compensation?
Via following the assistance team of the Hsinchu area, questions on to whether normative standards and related policies are realized on the ground become apparent, and the problem of avoiding victims to face a situation where insult adds to injury may be discussed. This thesis uses both national and international literature on the subject and compares these to interviews with practitioners, Through understanding current practices, differences between legal set-up and reality become apparent, Research results show how dealing with sexual assault cases involves a wide spectrum of work that can not be resolved by a single unit or institution, The perspectives of each assistance team in the criminal process is still facing many predicaments; staffing remaines insufficient; linkages between various assistance teams have yet to be strengthened, There is still a big gap of under-protection of victims when t comes to victim compensation expectations. Finally, the thesis submits proposals for alleviating current problems. It is hoped that implemention of such may ensure an even better protection of sexual assault victims within criminal procedures.
