不論是在東方或是西方的社會，與其他犯罪相較，性犯罪總是較容易引起社會上之關注與討論。近20年來世界各國有關各類犯罪加害人處遇法制之發展，亦偏重於性犯罪加害人之治療與預防。其中，對於性犯罪之加害人最為嚴厲的制度，當屬從美國的梅根法案所發展出來的性犯罪加害人登記與公告制度。梅根法案是1990年代美國有關性犯罪加害人社區預防處遇相關法案中最重要的法案之一。梅根法案完備了美國性犯罪加害人登記與公告之制度。該制度雖然曾引起各式的爭議，特別是有關加害人人權保障的部分，然美國社會卻幾乎是一面倒的支持。而此項支持，實際上亦不僅限於美國境內。從90年代開始，梅根法案亦無遠弗屆的影響了世界上其他國家有關性犯罪加害人處遇法制之發展。目前為止，全世界除了美國以外，已有英國、加拿大、澳大利亞、南非、法國、愛爾蘭、日本、韓國等8個國家訂有性罪犯登記法。至於我國，雖然亦於2005年參考了美國梅根法案於性侵害犯罪防治法第23條修訂了性侵害犯罪加害人之登記制度，2011年並就我國之登記制度做了些微的修正，然探就我國相關法規，與其他國家相較，似乎甚為保守。本文即預備透過相關文獻資料之蒐集，了解美國及其他受梅根法案影響的國家實施性罪犯登記與公告制度之經驗、成效，再藉由各個國家不同實施方案之比較，深入進行討論，進而反映出國內未來性侵害犯罪加害人在登記與公告制度上應補強與修正之事項，並提供具體可行之措施或方案以供我國未來立法、修法之參考。

英文摘要：

In today's world, society loathes sex offenders more than almost all other criminals, laws regulating sex offenders evidence this public enmity. In United States, Megan's Law probably is the most controversial and influential sex offender law. Enacted in 1996, Megan's Law created a statewide registration and notification program and urged all states to implement similar statute. All states in the United States quickly followed with both registration and notification laws. Despite some of the controversy, state government enthusiastically supported Megan's Law and often enacted similar legislation with little to no opposition. The support of Megan's Law can be found in other European and Asian countries as well. As of 2009, eight nations-the United Kingdom, Australia, Canada, France, Ireland, South Africa, South Korea and Japan-have implemented sex offender registries in order to track and deter these criminals. Furthermore, in 2010, South Korea will soon become the second country in the world after the United States to allow public access to sex offenders' personal information via public notification laws. Influenced by the Megan's Law, Taiwan enacted its own sex offender registration law in 2005. However, compared with sex offender registration law of other nations, the law in Taiwan is much more conservative and narrow. Therefore, as more and more nations pass laws regarding sex offenders' registration and notification, it is necessary to examine these different measures and evaluate our own policy.
