美國電子監控性犯罪者的經驗-以美國加州為例The Experience about Using Electronic Monitoring to Supervise Sex Offenders in USA:The California for Example

  因為科技的日益發達,對於刑事政策產生相當的影響,電子監控(科技設備監控)就是一個明顯的例證。自 2005 年《性侵害犯罪防治法》修正後,我國開啟電子監控的時代,希望藉此杜絕受保護管束的性侵害犯罪者再犯,然而我國法制尚不健全,雖然 2011 年又進行修法,但仍有諸多需要改進之處。對此,本文以為可以參考美國電子監控法制。美國是世界上率先使用電子監控的國家,尤其在全球衛星定位系統(GPS)投入監控工作後,更顯發達。然而,美國電子監控之於性犯罪者,是經過長期發展而有今日規模,我們先對美國法制的發展進行瞭解,諸如梅根法案、潔西卡法案、亞當‧沃爾許法案等,尤其是美國加州法;爾後,再探討美國法制可能給我國的啟發。

 

● English Abstract:

 

     Due to advanced technological equipment, resulting in criminal policy change. Electronic Monitoring (EM) is an obvious example. After 2005, the relevant provisions of the Electronic Monitoring appeared in Taiwan's Sexual Assault Crime Prevention Act. People want to prevent sexual offenders reinvade by Electronic Monitoring. In 2011, legislators amended the relevant provisions of the Electronic Monitoring. However, there are still many deficiencies. For this issue, Taiwan can refer to the American legal system. U.S. is the first country to use the Electronic Monitoring. In the U.S., there has been a recent proliferation of laws that require the use of Electronic Monitoring for specified sex offenders, especially Global Positioning Systems (GPS). The article think we must understand American history about Electronic Monitoring Law, for example, Megan's Law, Jessica's Law, Adam Walsh Child Protection and Safety Act and so on, specifically California Penal Code. Afterward, we can think how to amend Taiwan Electronic Monitoring Law.
