父權作為一種社會權力運作的模式，其所影響的範圍非常廣泛，在性侵害犯罪層面，已有研究顯示，性犯罪者之父權心態強烈與否，與其對被害者同理心相關。甚有學者認為犯罪者因其父權心態與性別歧視導致性犯罪的發生。在父權體制下，父權概念是以性別作為基礎運作，並將陽剛特質優於陰柔特質的模式套用到男性與女性身上，於此架構下對於男性自我形象的建構，成為壓迫女性的思想來源，而女性長期在這樣的思想教育下，容易產生自我懷疑，在壓抑自我與展現自我的價值矛盾下，進而形成對自我形象的錯亂，間接導致在被性侵的第一時間不敢反抗甚至貶抑自身價值。於此思想普遍存在的社會，男性容易將女性的服從視為其展現權威的表徵，藉此彰顯其優勢以符合社會期待。而性暴力便成為性犯罪者最直接的證明方式。
於《房思琪的初戀樂園》一書出版後，此書衍生事件引發當局重視及檢調單位調查，本文欲藉書內所描述的性侵情節，探討在父權社會的思想體系下如何對女性被害者產生影響，並以此議題為核心，藉由相關之媒體報導、文獻資料及實務判決，闡述父權思維如何形塑性侵事件中社會輿論之走向、被害者事發後的態度以及其對自身想法之轉變，並就現行法律制度作初步探討。
《房思琪的初戀樂園》一書內各章節的情節安排除卻對於性侵加害者之控訴外，並揭示部份女性在父權社會及教育下被迫接受的觀念與行為準則，本文除藉此書描述在父權社會影響下女性受壓迫後所呈現的各種面向外，並欲探討書中「房思琪式的強暴」現象，與普遍存在於華人社會道德觀背後的父權思維有何關聯。研究過程係運用深度訪談之方式蒐集資訊並輔以相關文獻作為分析主軸，試圖傳達性侵案件中多數女性仍受制於父權體制所形塑的思維框架下的無奈。法律制度在妨害性自主要件上的改革，雖對於現行司法實務具一定程度的影響，惟根本仍應從如何讓人們在正視這個已內化壓迫與對立的社會體制後，找到能更貼近被害者傷痛的補救方式，逐步改變社會對於性侵案件的氛圍及認知。

英文摘要：

Patriarchy which has a great influence widely has made a mode of social power operation. In the level of sexual assault crime, the research has showed that the offender’s empathy towards victim depends on patriarchal mentality whether the sex offender has strong enough or not. Moreover, other scholars believe that sex crimes have been happened by sex offender due to their patriarchal mentality and gender discrimination. The concept of patriarchy is based on the gender that could be classified by masculinity and femininity in the patriarchal system. The source of thoughts that is constructed under the framework of male self-image has become the oppression of women. Women have been under the kind of ideological education for a long time so that it makes women self-doubt easily. Self-depression and self-worth contradiction result in women being self-image confused. Indirectly, they also cause them to be the sexual assault not to resist at the first time, even self-deprecation. Male treat female obedience as a sign of their authority that could conform to social expectations in society of male thoughts. Thus, the sexual violence is the obvious and direct proof of sex offender.

According to the book " Fang Ssu-Chi’s First Love Paradise", it has caused the matter to make the department of inspection pay attention and investigate. This article quoted the plot of the sexual assault from the book to discuss how the female victims are influenced by ideological system of patriarchal society. And the issue is as the core of the article. By relevant media reports, literature, and practical judgments, they are explained how patriarchal thoughts lead the way into the social opinion of the sexual assault, the victims’ attitude and transformation of their own thoughts. Therefore, preliminary discussion is under the current legal system.

The plot arrangement of each chapter in the book "Fang Ssu-Chi’s First Love Paradise" not only accuses the perpetrators of sexual assault, but also reveals the concepts and behaviors that women are controlled by patriarchal society and education. This article not only quoted that the book describes those various aspects after women have been oppressed by the influence of patriarchal society, but also discussed the correlation between the phenomenon of 「the rape of Fang Ssu-Chi’s type」 and the patriarchal thoughts under the morality of Chinese society. The process of research uses in-depth interviews to get the information and analyze the relevant literature to figure out most women still have been controlled by patriarchal thoughts. Interference with sex liberty in the legal system has been reformed. Although the change has influenced current judicial practice, to an extent, it is still necessary to find a way to let people to face on this oppression and opposition of social system. If we found out the way to heal the hurt of victims, the social atmosphere and perception of sexual assault cases would be changed gradually.
