警察回應新住民家庭暴力案件程序與處理經驗之研究─以臺中市政府警察局為例 The Dealing Procedure and Experience of Police Responding to Domestic Violence of New Immigrants─A Case Study of Taichung City Police Department

全球化的移民浪潮下,臺灣對於鄰近國家,產生人口遷移拉力,新住民婚姻移民造成臺灣社會人口結構改變。根據內政部統計,目前已有將近52萬人口的新住民配偶,主要以大陸、港澳地區配偶人數為最大宗,其次為來自東南亞國家的新住民。對於新住民而言,由於語言、文化的差異,無法順利融入我國生活環境,不僅人際關係較為孤立、社會支持網絡也較缺乏,且因為臺灣傳統社會種族優越主義,對於社經地位相對較低的外籍配偶態度並不友善,因此容易衍生新住民家庭暴力案件的發生。
國家的婦幼保護政策是成立一個家庭暴力防治網,期望透過整合服務的模式,結合警政、社政、衛政、教育及司法體系共同來提供完整的服務。新住民家庭暴力案件之處理,警察通常位居第一線之樞紐。隨著每年家庭暴力案件通報件數的增加,警察機關為各通報單位件數最多的機關。是故,警察對於處理新住民家庭暴力案件之程序與經驗,對家暴被害人影響甚鉅。
本研究乃聚焦於臺中市政府警察局警察人員對於新住民家庭暴力案件之處理程序上是否遭遇什麼困境?且筆者亦任職於臺中市政府警察局擔任基層員警及擔任派出所社區家防官,故希望透過本研究提出有效之建議。
本研究藉由訪談六名警務人員,分別為分局家防官二名以及四名派出所員警,以了解目前於實務上員警處理新住民家庭暴力案件是否遭遇困境、影響員警處理新住民家庭暴力案件之因素與角色定位問題以及警政署於2014年進行組織改造後,婦幼業務由外勤單位移撥至內勤單位所衍生之組織內、外部溝通問題。
研究發現,警察於處理新住民家庭暴力案件上,影響員警處理新住民家庭暴力案件有諸多因素,這些影響因素對警察角色轉換是依所選擇採取措施而有不同。在內部溝通上,由於組織改造,婦幼業務於內部組織及人員溝通上衍生許多的問題;在外部溝通上,警察於處理家暴案件時最容易接觸到的為社政機關,因此容易衍生許多溝通聯繫上的問題需要協調;以及,分局家防官於人員遴選的條件資格限制有待改善。
因此,本研究建議警察機關於新住民家庭暴力案件處理上,應協調組織內、外部溝通、強化外部有利於新住民家暴案件處理的民間資源以及選任適合之婦幼專責人員並落實員警婦幼安全教育訓練及婦幼專業證照化,以增進案件受理的品質與效率。

Since the global immigration wave, marriage immigrants from nearby countries have changed the demographic structure of Taiwan. According to statistics of Ministry of the Interior, there are approximately 520 thousand immigrant spouses in Taiwan of which are primarily from China, Hong Kong, and Macau. And South-East Asian countries comes in second. Due to the culture and language differences, it is difficult for these new immigrants to fully immerse themselves into local society and thus causes the interpersonal alienation and the lack of social support networks. These foreign spouses are being treated in unfriendly manners not only because of their low socioeconomic status, but also the racial superiority in Taiwanese traditional society. And this is also the main reason for the endless domestic violence in these foreign spouse families.
In order to provide a comprehensive service, the policy on women and child protection is to prevent domestic violence by building a network that combined with policing, social welfare, medical care, education, and jurisdiction. The increasing domestic violence reports are mostly come from police agencies. This means that police is on the frontline in domestic violence cases. Therefore, the procedure and experience of police in domestic violence cases have a great influence on new immigrant victims.
The purpose of this study is to analyze whether there is any difficulty when police is in charge of domestic violence cases involving new immigrants. The author hopes to provide effective recommendations based on the personal work experience as a domestic violence protection officer in Taichung City Police Department.
In this study, six police officers, including two domestic violence protection officers of precincts, and four police officers from police stations, were interviewed. The purpose is to explore whether there are any difficulties in dealing with cases involving new immigrant domestic violence they had before. And further understand how the restructure of police department in 2014 had influence on role of police in these new immigrant domestic violence cases.
This study has found that there are quite a few elements that affect police when they take charge of domestic violence cases involving new immigrants. These elements have different effect base on the police role and procedure in the case. In internal aspect, there are obstacles in communicating with women and children protection cases due to the organization restructure. In terms of external communication, it is found that there are always derivative problems between police and the social welfare organizations. And they contact the most while processing the cases. Qualification and restrictions of the precinct protection officers need to improve as well.
This study recommends the police to have coordination between external and internal communication, enhance available resources of non-government institutions, select a designated human resource system, implement education as well as training, and professionalize protection of women and children. In order for these missions to be accomplished, the efficiency and quality of the police in women and children protection cases need to be vastly improved.
