家庭暴力被害人緊急救援機制之研究-以臺北市社工人員與警察之合作為例

  本研究目的係探討現行臺北市家庭暴力防治中心社工人員與警察人員,進行家庭暴力被害人緊急救援合作情形,並瞭解社工人員與警察人員在家庭暴力緊急救援認知上與實務上之差異,以提供實務界對於家庭暴力被害人緊急救援,社工人員與警察合作機制之規劃。
本研究係以檔案文獻分析及焦點團體方式進行資料蒐集與分析。檔案文獻分析範圍包括相關法規、標準化作業規範,以及相關網絡會議紀錄等資料。焦點團體之執行,係以立意抽樣方式,針對臺北市家庭暴力防治中心及臺北市政府警察局,分別選取十二名社工員、七名警察人員,以及九名社工員與七名警察人員,共進行三場焦點團體,以蒐集現行警察與社工合作情形、職責認知上的落差以及合作的問題,並進一步探討現行與建議未來有效之合作模式。
有關本研究結果,茲分述如下:
一、現行法規與作業程序規範緊急救援合作情形
經檔案文獻分析發現,相關法規與作業規定已具有跨領域整合意涵,而在實務操作上,警察人員與社工人員依據現行工作指標與流程規定,提供緊急救援服務上,多數警察人員不清楚社工觀點的指標,以至於產生合作上的問題。
二、緊急救援合作認知與實際執行情形
蒐集警察與社工經驗,歸納出到場協助被害人之三種合作型態,包括「只聞聲不見人型」、「你我並肩作戰型」與「大隊接力型」。另發現社工與警察對於彼此緊急救援職責的認知與落差。
三、社工人員與警察人員合作障礙之探討
現行臺北市家庭暴力防治社工人員與警察人員合作上,因為萬華劉小妹通報懲處的重大事件,致原本關係不太穩固的雙方,彼此關係更降至冰點。歸納本研究發現目前存在臺北市家庭暴力防治中社政單位與警政單位合作上的障礙,包括「信任關係衝擊」與「結構條件不足」。
四、社工人員與警察人員合作機制之建立
歸納與談的社工與警察人員經驗與建議,認為建立有效的合作機制,包括「任務執行連結機制」與「關係維繫機制」。前者為現行的合作模式,係透過長官下達命令的機制,可順利連結社工人員與警察。並建議未來應建立及時問題反應機制,以促進雙向且及時之問題溝通管道。而後者則建議朝向區域化網絡聯繫模式,透過分區派駐社工,以及深入區域性教育宣導的方式,以有效建立合作共識。
最後本研究依據研究目的與結果,針對政策制定、實務執行及教育養成等三方面提出建議。

 

● English Abstract: 

 

     The purpose of this study is to investigate the emergency rescuing cooperative mechanism of victims suffered from domestic violence. The mechanism is conducted by the social workers in Taipei Domestic Violence Center (hereafter TDVC) and policemen from the Taipei City Police Office. Besides, this study also explores the gap between task recognition and implementation of both parties on the aspect of rescuing cooperative mechanism, the barriers within the emergency rescuing cooperative mechanism. This study intends to provide reference for the future planning of the emergency cooperative mechanism.
This study uses qualitative research to gather the data and conduct analysis. The data are gathered from prior file literatures and focus groups. Adopting purposeful sampling method, this study held three focus groups, which include 12 social workers, 7 policemen, and 9 social workers and 7 policemen, respectively. Data are collected to explore the cooperation condition between the policemen and social workers, the gap existed in the task recognition, and the problems of cooperation.
The research results are summarized as follows:
1. The emergency rescuing condition regulated by current rules and work procedure criterion.
The file literatures show that related regulations and work criterion have contained the implication of across fields integrating. In practice, policemen and social workers providing the emergency rescuing services based on the current work index and procedure criterion, which still exist the problem of cooperation.
2. The cooperation recognition of emergency rescuing and implementation condition.
According to the experience of policemen and social workers, three cooperation types about the policemen and social workers assisting with the victims in present are concluded in this study. In addition, this study also concludes the recognition gap related emergency rescuing tasks between the social workers and policemen.
3. The investigation on cooperation barrier between the social workers and policemen.
In currently, the cooperation barrier confronted by the social workers in TDVC and policemen is becoming serious. The reason is due to one significant event related a child who suffered by domestic violence, and related personnel did not deal this event very well; it results in these personnel facing the punishment. Hence, the relationship between social workers and policemen is becoming more and more weakly. This study finds that the barrier existing among the social workers and policemen includes the impact of trust relation and the insufficient structure condition.
4. The establishment of cooperation mechanization from both the social workers and policemen.
According to the experience and suggestions from social workers and policemen, they suggest that the effective cooperation mechanization includes tasks implementing connection and relation maintaining. On the tasks implementing connection mechanization, they think that it can be through by the superior officers to transmit the commands to lower levels, thus, this way can connect the social workers with policemen successfully under the currently effective cooperation model. Besides, they suggest establishing mechanization of timely problem response in the future in order to promote both of them to communicate with each other.
Accordingly, on the relation maintaining mechanization, they suggest it should be forward to the regional network model. It means that dividing the social workers into different regions to go deep into promote regional education, and pull the relation between the social workers and policemen more closely. It will establish the effective cooperation common consensus to further help the victims who suffered from the domestic violence.
Policy and practice recommendation are proposed based on the research findings.
