原住民家庭暴力與警察回應之探討--以花蓮東賽德克地區為例

  家庭暴力一直是存在著的社會婦女安全問題,民國八十七年六月以前,雖然是大家談論著的焦點,但未有處理及依循的方針。直至婦女團體推動婦女政策立法,將家庭暴力防治法繼性侵害防治法後,再完成一個保護婦女權益的法律。這使得社會一直存在著家庭暴力是個人家務事的錯誤迷思,終於以法律來規範並保護被害人基本人權,也使得一直遭受家庭暴力並因家庭迷思而躲在陰暗角落身心受傷的被害人得以受到法律保護及公權力的救援。
原住民有其特有的傳統文化背景,國內目前有十二個原住民族各有其不同的文化,而不同的文化產生不同的社會結構。原住民文化經歷其他多元文化的衝擊下,均有所變遷或更佚,也因此造成釵h不同面相的社會現象,因此,文化變遷是探討原住民家庭暴力文提相當重要的一個課題。本研究中是以花蓮地區東賽德克泰雅族原住民為對象,探討東賽德克泰雅人(含泰雅族及太魯閣族)家庭暴力的狀況及其文化變遷、社會結構改變的影響。在傳統東賽德克文化中,GAYA束縛著家中的每一個成員,不容酗k性結婚後背離家庭,雖然存在著家庭暴力、男尊女卑的現象,但家庭結構完整。但經日本理蕃統治、國民政府各項開放政策,使得原住民接觸外界多元文化後,傳統文化的衝擊、解離,造成了更多的社會問題與家庭暴力情事。根據統計,花蓮縣市全國各縣市中家庭暴力案件報案率(每萬人)最高的,而東賽德克泰雅人是花蓮各族群中因家庭暴力案件報案率最高的,的確是值得我們重視與注意的一個社會狀況。
警察是執行家庭暴力防治網絡中接觸被害人最多也最早的第一線人員,警察的態度與執行成效攸關著立法意旨與整體防治工作的效能,而警察在執行處理家庭暴力防治工作過程中的態度與能力又可能因員警本身的訓練、認知、個人特質及文化認知迷思而有所差異,因此本研究即針對在花蓮東賽德克地區服務的警察做探討,發現部分警察仍存在著家庭暴力及族群的迷思,甚且不同族群的原住民警察與當地原住民有相當的隔閡,例如在東賽德克地區,阿美族警察覺得被當地太魯閣族人排斥;布農族警察就相當不受當地太魯閣族人歡迎,被認為執行最有偏差、態度較差的警察族群;而平地漢人警察則認為原住民的家庭暴力是嚴重而無法解決的、警察最好不要介入或不處理原住民的家庭暴力案件。研究可知警察在族群文化上仍有相當大的隔閡。若欲提升整體防治工作成效,在警察部分是需要在體制、訓練上做相當的努力。
家,是每個人生活的根源。每個人也有活得安全、不被暴力危害的基本權力,冀望在各界不同部門的共同努力下,只要是活著的各不同族群人們,都能不再受家庭暴力的壓力壓迫,活得有尊嚴、幸福、快樂。

 

● English Abstract: 

 

     The family violence is always the problem of the female security in Taiwan society. Before June, 1998, the main points were discussed, yet there were no disposition and guidance. After the female organization promoted the law of Female Policy and the prevention of continuous violence, the law of protecting female right was accomplished. There was a wrong concept in Taiwan society that the family violence was the private matter. Then the basic human rights of the victims were protected by the law and the regulation. The victims of the family violence influenced by the error family concept could get the help of the authority based by the law.

The tribal people in Taiwan have their own particular tradition and cultural background There are twelve tribes in Taiwan and their different cultures form numerous social structures. Under the multiple culture shock, the tribal cultures have to be restructured. and confront social phenomena. Therefore the culture change is the most significant theme to be probed. The research center in Hualien district took East-sedeg tribe including Ataiyal tribe and Troko Tribe as the subject to research the condition of family violence, its cultural changes, the social structure and the influence of the social change. Gaya system in Sedeg society restrained every family member, not allowing married females leaving their families. The family violence and man priority existed, yet the family structure was healthy .Under the policy of controlling tribal people by Japan and the policy of open society by National Government, the tribal people contacted multiple cultures which impacted their traditional culture making lots if social problems and family violence. In Taiwan, Hualien county has the highest ratio of family violence cases reported to the police according to the statistics. Really it is worth to pay much attention to this social condition.

When the police enforce the family violence prevention, it is the first line to contact the victims mostly and earlier than other organizations. The attitude and the executive efficiency of the policemen relate to the essence of the law and efficacy of the whole preventing works. When the policemen execute the prevention of the family violence, the attitude and efficiency of the policemen depend on their training, acknowledgement, personal characteristics, and comprehending cultures. When the research center probed the policemen working in East-sedeg district in Hualien as the project, obviously there were some policemen having a wrong concept of family violence and tribe society. Moreover there was a gap between tribal policemen and tribal people. For example, Ami tribal policemen felt they were rejected by Taroko tribal people. Bunun tribal policemen were mostly not welcomed by Taroko tribal people. They were evaluated as a group of policemen who had less ability of performing with a bad attitude. The Chinese policemen in the plain area believed that there was no way to resolve the family violence in tribal society so that the policemen had better not involve in family violence. In order to improve the prevention work, it needs to make an effort improve the organization and training.
Family is the root of everyone’s life. Everyone needs a safety life and a basic right of not receiving violence. No matter which tribe one lives, he can live without family violence and live with respect, happiness and joy.
