台灣地區家庭暴力犯罪因素之研究—以桃園縣為例 The research of domestic violence crime factors - Tao Yuan County as an example.

本文的目的是研究家庭暴力犯罪因素，而且以桃園縣政府警察局92年受理之家暴案件為分析對象。將目前家庭暴力之現況、特性與家庭暴力再犯的特性做深入的研究。利用描述性統計、自動互動檢視法及對應分析等統計方法並獲得以下列結果：
ㄧ、被害人以女性居多(88.65%)，而相對人則多為男性(93.02%)。兩造職業均以「無業」或「工」居多，教育程度均為高中/職以下且年齡均在31-40歲者居多。
二、犯罪之場所集中在「家中」，時段集中於17至凌晨2點。
三、相對人有酗酒的不良習慣，其次彼此個性不合；並以婚姻關係暴力或共同生活居多，被害人多為配偶。
四、家暴犯罪對於被害人身體上之侵害，集中在頭部及身體，相對人在法律上之罪名均以傷害罪移送。
五、家暴犯罪有重複再犯之特性，比例高達八成二，僅有二成九的被害人曾向警察機關求助，而提起告訴者有3.64%，曾因此被捕有1.55%，法院判決核發保護令確定者有3.59%。
六、研究結果可提供警察、社會局及司法等政府單位以及婦女團體、家扶中心等民間團體在未來執行家庭暴力防治方案與政策擬訂作為參考依據。
English Abstract:
The purpose of this thesis is to investigate the crime factors of domestic violence. The study objects is the domestic violence legal cases which reported to Taoyuan county police stations during year 2003. We deeply investigate the present status and find main factors of domestic violence. Statistical methods, descriptive statistics, Chi-squared Automatic Interaction Detection (CHAID) and Correspondence Analysis, were applied and found the following results.
1.Most of the victim are female (88.65%) and the most of the opposite party are male (93.02%). The occupation of both parties are the jobless or the laborer, the level of education is generally the senior high school and age at 31 to 40 years old.
2.Most of the crime location is at the home and the time is between 17:00 to 2:00 A.M..
3.Most of the opposite party are althol abusers. The relationship between both parties are marital relationship or live together, and the victim mostly is spouse.
4.Most of victims were hurt on their body or head. The opposite party were hand over with assault in the criminal of the law.
5.A main characteristic of domestic violence crimes is recidivist (82%). There are 29% victims have been asked for help from police, 3.64% of opposite party has been charged and it cause 1.55% crime be arrested; 3.59% of them got the protection from Abuse Order from the court.
6.The results can provide the basis and consultation to government units, for example, police, the department of social welfare and judicatory or the civil groups such as women's group or “Family Helper Center.” The results could suggest for domestic violence prevention and policy’s draft in the future.
