南投縣家庭暴力防治與網絡聯合救援機制之研究 A Research of Domestic Violence and Joint Network Rescue Mechanism in Nantou County

  家庭暴力乃長久以來的社會問題,如今已不被視為家務事,而是嚴重的犯罪行為。家庭暴力防治法之施行,為公權力介入家庭暴力問題的開端,政府有關機關應如何積極防治,加強網絡整合與協調合作機制,並落實法律的相關規定,對被害人適時伸出援手,以免讓家庭暴力問題不斷擴大,實為家庭暴力防治能否發揮弁鄋漲迂捙鶬銦C因此,本研究以家庭暴力之婚姻暴力為核心議題,探討受暴婦女主要求助對象之第一線警政與社政人員網絡聯合救援之實務困境,並進一步分析影響應然與實然間之落差因素,進而提出可供改進的參考建議,以建構務實完善聯合服務對策。
本研究採立意抽樣的方式,進行資料蒐集與分析,針對南投縣政府家庭暴力暨性侵害防治中心社工員及南投縣政府警察局員警實施訪談,深度訪談5名社工員及14名警察人員,藉由訪談過程以呈現警察人員與社工員實務合作狀況、進一步找出問題之癥結與改善方法,並發展適合地方特性的家庭暴力防治服務網絡。主要研究發現如下:
一、家庭暴力犯罪防治與救援模式
113婦幼保護專線於防治家庭暴力雖可提供諮詢、案件列管,惟113專線社工員專業不足,受理案件未篩選,浪費警力;台灣親密關係暴力危險評估表(TIPVDA)雖可提供案件評量達到案件分流,惟客觀性遭致質疑,易造成誤判情事。
二、影響警察與社工防治家庭暴力救援之困境因素
由於地方首長對家庭暴力防治工作不重視,以及財政困窘,連帶造成警察與社工人力資源不足,而勤業務之繁重影響,導致專業能力不足,加以當事人個人不願意配合、教育、衛政機關參與意願不高、加害人處遇治療執行困難、緊急庇護及處遇資源不足、法令不周延及法院核發保護令裁定時間過於冗長等因素,嚴重影響警察與社工處理家庭暴力案件之態度。
三、警政與社政合作救援之認知差距探討
聯合執行救援時,社工人員肯定警察之安全維護、逮捕或嚇阻加害人之角色,以及訪視時陪同之安全維護職責。當彼此產生認知差距時,大部分採取溝通協調之方式,以社工人員之意見為主,倘有個人資源者會尋求外部資源之協助,以解決被害人急迫需求。
四、警政與社政實務上之合作障礙探究
歸結警政與社政實務執行救援之合作障礙有專責人員配置問題、專業能力不足、網絡聯繫不足、緊急庇護處遇資源不足等問題。
因此本研究依據研究目的與範圍,針對研究發現分別在政策面、實務面、法制面提出建議,以供中央及地方政府參考,建構屬於地方特性之家庭暴力防治對策。

 

● English Abstract:

 

     Domestic Violence has been a social problem. Today, Domestic Violence is not treated merely as family affair but serious criminal behaviors.The enforcement of “Domestic Violence Prevention Act” is the dawn of interference of government authorities in domestic violence problems. How the related government organizations actively work to strengthen the network integration and cooperative mechanism to implement the regulations, and to give supports to the victim in time so as to prevent the problem from being more serious, is the key to succeed the function in the prevention of domestic violence.
Therefore, this research is focused on the spousal abuse in domestic violence, discussed on the practical dilemma in joint rescue between battered women and their main helpers, the first-line police and social workers. This research is further analyzed in influential factor causing the difference between the being and should being, and then provided improvable and referable suggestion to construct useful, flawless joint serviced strategy.
Our research based on “Judgmental Sampling Method” to process data collection and analysis, performed deep interviews with 5 social workers of the Domestic Violence and Sexual Assault Prevention Center, Nautou County government and 14 police officers of the Nantou County Police Bureau. By means of these interview processes, we could display the real co-work situation between police officers and social workers and further find out the bottleneck of the problems, and develop domestic violence prevention service network based on the local area characteristics. The main research results show as below:
1. Domestic violence criminal prevention and rescue model
Although the line 113 for women and children in protection of domestic violence could provide consultation and case control, the fact that the employees of line 113 is not well-disciplined causes the registered case not-filtered and police resources wasted. The TIPVDA could provide case assessment for diffluence, but its objectivity is being criticized for leading to misjudgement.
2. Factors of predicament influencing domestic violence prevention and rescue by police officers and social workers.
Due to the local government chief’s indifference to domestic violence prevention and financial shortage, it causes the human resource insufficiency in police officer and social worker. Besides, the burden of on-duty jobs brings about the deficiency of specialty. Moreover, the individuals, education, and health organizations are unwilling to participate, the execution of treatment for the offenders is difficulty, the temporary shelters and treatment resources are insufficient, the enactment is inadequate and the time for issuing protection adjudicate from court is too long. All these factors severely influence the attitude of police officers and social workers in dealing with the domestic violence cases.
3. Discussing the cognitive difference in the co-work rescue of police and social administration
When performing joint rescue, social workers acknowledge the role of police officers in security maintenance, arresting, deterring offenders, and the duty of safeguard in interview escort. Communication and coordination are the main procedures when cognitive difference occurs and social workers’ opinions are used to be adopted. In case personal resources are available, they will ask help outward to solve the emergent needs of victims.
4. Exploring the practical co-work hindrances between police and social administration.
To conclude the practical co-work hindrances between police and social administration in performing rescue, the problems include on-duty personnel deployment, specialty deficiency as well as the insufficiency of network connection and temporary shelters and treatment resources.
Hence, based on our purpose and scope probed, focusing on what are discovered, this research proposes suggestions in policy, practical and legal aspects to the central and local governments for references and constructs countermeasures of domestic violence prevention with local characteristics.
