我國家庭暴力防治網絡之研究--以被害人保護網絡為例 Research on the Domestic Violence Prevention Network in Taiwan- The Case of Victims Protection Network

  本研究係為避免網絡疏漏所可能產生的悲劇,針對家庭暴力防治法所建構之防治網絡,區分以社政為中心的被害人保護與決策網絡、以法院為核心之保護令聲請與裁定、以警察為核心之保護令執行、以衛政為中心的加害人處遇等網絡,以文獻分析闡述其所共構的家庭暴力防治網絡概況、出現哪些無法協力合作的現象/問題,另以質性研究深度訪談方法,依內政部94年家庭暴力及性侵害評鑑結果特優及優、甲、乙等第縣市,對社政、警政、教育、衛生等網絡利害關係人共十二人進行諮詢、情報、情感網絡建構情形之訪問。本研究肯定情感、諮詢、情報網絡與縣市評鑑績效相關性的研究假定,而社工員獲得的利益低於工作投入量,成員所產生的不公平認知影響服務品質,婦幼隊人員無刑事背景則無法指揮辦案,恐成為警政人員口中的女性次等聚集區,通報處理流程的不確定與不信任影響教育人員通報意願,衛政人員對於政策目標與工作流程的疑慮影響人員穩定性,防治網絡主要窗口因各有瓶頸無法形成緊密的連結,則被害人服務的疏漏將無法避免,影響所及,人員流動,影響制度化、規則化、標準化防治措施之建立,並拉長承辦人摸索、學習時間,形成惡性循環,另資訊的回流與控管,大部份未建立雙向的回報、因應與統計機制,形成服務控管、督考盲點;在人力、經費、組織增編之外,防治網絡單位應思考加緊情感、諮詢、情報網絡模式之建構,以確保服務品質。

Research on the Domestic Violence Prevention Network in Taiwan
- The Case of Victims Protection Network

The purpose of this research is to prevent the tragedy that might arise from the shortcomings and flaws in the victims protection network, and the focus of the research is on the establishment of domestic violence prevention network based on the Domestic Violence Prevention Acts.
The main prevention network can be divided into the following networks, namely, (1) Social-administration-based Victims protection and decision-making network, (2) Court-based protection orders application and assessment network, (3) Police-based protection orders enforcement network, and (4) Health-administration-based domestic violence offender treatment network.
Literature review analysis was performed to provide an overview of the current status of domestic violence prevention networks, and also to describe the phenomena and problems that might hinder the potential of full cooperation in the networks.
In addition, qualitative research was carried out on 12 key persons by using in-depth interviews on their current status of network establishment, regarding consultation, information and emotional support networks. The 12 research subjects were workers in the networks of Social Affairs Administration, Police Administration, Education Administration、and Health Administration, from among counties and cities of excellence, with their performance ratings ranging from Excellent、Good、to Poor, based on the year-2005 results of domestic violence and sexual abuse prevention evaluation issued by Domestic Affairs Administration.
This research validates the research assumptions that there exists a positive correlation between the establishment of emotion, consultation and information networks and the performance ratings of counties and cities evaluations, and that the prevailing perceptions of imbalance between high work inputs and low rewards that social workers hold could severely affect their service quality.
Women and Children Protection Brigade generally lack criminal justice training backgrounds, and tend not be unable to coordinate investigation tasks. As a result, they tend to become being depreciatively regarded by some police administration personnel as the so-called gathering areas of female sub-groups of inferiority. The uncertainties of reporting process and the lack of trust all contribute to the low willingness of reporting by education personnel.
The doubts that Health Administration works have towards policy goals and work process flows also pose negative impacts on their work stability.
Many problems and difficulties still remain unresolved among main windows of prevention networks, thus keeping these networks from being closely linked together, and making service lapses in victims grievance inevitable. Furthermore, personnel’s work instability inevitably affect the progress in systematization and the establishment of standardized prevention measures, and therefore prolong the time it takes for searching, learning, thereby ending up forming a vicious circle.
Moreover, with regard to information feedback and control, the two-way feedback system and the response and statistical mechanism have largely yet to be established, giving rise to blind-spots in service control, supervision, audit and review. Besides the expansions of human resources, budgets and organizations, the prevention networks should consider the establishment of modeling methodology for emotion, consultation and information networks, so that service quality will be ensured.
