殺人犯罪被害者遺屬在刑事訴訟程序之心路歷程A Study on the Psychological Paths in Criminal Procedure of Homicide Victims’ Survivors

殺人犯罪無論對於被害人、被害人家屬乃至於社會而言,無疑是影響最鉅的犯罪類型之一,但由於殺人犯罪發生頻率甚低且敏感度較高,相關的研究卻遠不及其他犯罪類型。是以本研究透過質性研究方法,以立意抽樣選取3名殺人犯罪被害者遺屬進行深度訪談,旨在探索殺人犯罪受害者遺屬對刑事司法程序的主觀感受與詮釋,進而理解司法訴訟經驗對於受害者遺屬的影響。 本研究發現如下: 一、刑事司法人員消極的態度可能造成受害者遺屬心理上的額外負擔。 二、刑事司法人員疏於即時提供司法程序資訊及告知案件進度。 三、刑事司法判決結果未必能發揮撫慰受害者遺屬的功能。 四、犯罪被害補償金的立意與運作有悖於受害者遺屬的期待。 綜合以上發現,提出3點政策建議: 一、刑事司法人員應給予受害者遺屬更多的尊重與同理心。 二、對於未踐行權利告知及訴訟程序通知之情勢,應有相對應的法律效果。 三、強化加害人與受害者遺屬得以接觸的制度化管道。 It’s beyond question that homicide is one of the most deleterious crimes to the victims, victims’ family and the society. However, homicide-related studies are far less than those of other types of crimes, for its low occurrence and high sensitivity. Thus, this study adopts qualitative research method, namely interviewing three homicide victims’ survivors, to understand their psychological paths in criminal procedure and the impact of the criminal procedure on them. The findings from the interviews are summarized as follows. Firstly, the passive attitude of the criminal justice personnel may bring additional psychological strain to the homicide victims’ survivors. Secondly, the criminal justice personnel sometimes fail to offer the information of criminal procedure information and the process of case in time. Thirdly, the verdict can not always pacify the homicide victims’ survivors. Fourthly, The purpose and operation of the state compensation system do not meet the expectation of the homicide victims’ survivors. Based on the above findings, three suggestions for future improvements are offered. Firs of all, the criminal justice personnel should show more respect and empathy to the homicide victims’ survivors. Also, certain punishments should be carried out to those who fail to inform the homicide victims’ survivors of their rights and the criminal justice procedure. Thirdly, the institutionalized access for the reconciliation between the offender and the homicide victims’ survivors should be reinforced.
