殺人事件中犯罪者與被害人關係研究 A Study on the Victim-Offender Relationships in Homicide Cases

過去有關暴力殺人的研究不少,但卻著重於殺人犯罪者特性的敘述為主。最近一些犯罪學者則企圖從犯罪者與被害人關係的角度來瞭解殺人犯罪,然而,由於學者對犯罪者與被害人關係的分類太過於簡單,吾人仍舊無法洞悉殺人犯罪問題。本研究擬以Decker(1993)所提的五種關係類型(包括:陌生人、普通朋友、熟識朋友、親戚、與情感有關者等)做為基礎,探討這五種關係型態與殺人犯罪事件特性的關聯。本研究支持殺人犯罪微觀的研究取向,我們發現,殺人犯罪事件中加害人與被害人的關係與殺人動機,加害人及被害人人文背景及犯罪事件的特性等皆有關聯。研究之結果可做為刑事司法人員偵辦殺人犯罪案件的參考。

 

English Abstract

 

Previous research on homicide are numerous. However, most studies are descriptive in nature, focusing on the characteristics of the offenders. Recently, a few criminologists have attempted to examine the relationships between offender and victim. Unfortunately, their attempts were frustrated due to the dichotomous classification of the victim-offender relationships. The classification has been criticized for being too simple. This proposed research would utilize Decker's (1993) five types of victim-offender relationships, including stranger, acquaintances, friends, relatives, and the romantically linked, as the basis of understanding homicide. The relationship between this classification and homicide related behavior, such as criminal motives, event characteristics, and demographic backgrounds of the offenders and victims are examined. The research concludes that victim-offender relationships are good indicators of understanding homicide cases. Particularly, victim-offender relationships are related to the criminal motivations, characteristics of the offender and victims, and criminal events. The research findings support a micro-level perspective on homicide study. Moreover, the findings should be able to help criminal investigators handle homicide cases.
