竊盜犯罪偵查之研究─以探討犯罪嫌疑為主

The purpose of this study will focus on the nature of the burglary from the perspectives of the criminal investigation. It is discussed in theory and in practice. Theoretically, the burglary is evaluated and predicted through observing the phenomenon and the investigation. Practically, major burglary samples were analyzed, and questionnaires were made. Samples of the burglaries were selected from major cases happened in this country, and were further analyzed by the type, means, place, time, and background of the suspects. Questionnaires containing burglary cases were shown to and answered by the experienced senior criminal investigators. Through the above research, it is concluded that: 1.The alleged crime types should be defined by the process of the criminal investigation and divided into: (1)pre-crime: intuition observation. (2) in the crime : to discover weak point. (3) after the crime: to retrace behind crime conduct. 2.The nature of alleged crime are divided into "active form "and "negative form". People have the instinct to perceive the abnormality of things that contradicts to our ways of thinking. To compare the normality with the abnormality, we may distinguish "active form "from "negative form" through the difference of the alleged crimes. In view of the above, it would be easier to unveil the allegedly crimes by practicing the concept of "active form "and "negative form"and by tracing their behavioral factors including WHO, WHAT, WHEN, WHERE and WHICH. 1.WHO: to include the mental status, behavior, expression and social status. 2.WHAT: to include heavy crime becomes light one or nothing , light crime becomes nothing. 3.WHEN: to include confidential time, time difference, personal living habit, vague alibi and perfect alibi. 4.WHERE: to include confidential, remote and special locations. 5.WHICH: to include too much amount, not accordant function, obvious script, looking for source.
