網路交易是一種新興的商業模式，透過網際網路而完成商業行為的交易活動，即屬之。電子商務是指採用電子方式開展商務活動，包括在供應商、客戶、政府機關、及其他參與方之間；透過任何電子工具（如電子郵件或訊息、EDI 技術、電子佈告欄、智慧卡、電子資金轉帳和電子資料交換等）共用結構化首非結構化商務資訊，來管理和完成商務活動、行政活動和消費活動的各種交易。本論文擬以網路交易模式入手，對網路交易模式為探究後，再以因網路交易流程所引致之商流、物流、金流及資訊流等面向，以刑法詐欺罪之成立與判斷流程來檢驗現行刑法詐欺規定對於相關網路交易詐欺之適應能力，以期對網路犯罪規範之擬定有所助益。
