守護人民財產,警察機關與金融機構防阻詐騙新思維—以臺南市為例 Protecting people's property, New thinking on blocking fraud in police agencies and financial institutions — Take Tainan City as an example

資訊時代促進了網路社會的加速發展,也使犯罪手法日新月異,犯罪者透過電信或網路間接接觸的新興詐騙形式,致使國內電信詐欺案件層出不窮,危害人民財產甚鉅。詐騙集團利用各種話術及手段詐取人民財產,吸收民眾當車手,但警方緝獲的車手、偵破的詐騙集團再多,民眾最關心的仍是損失的金錢能否取回,然而詐騙集團幾乎層層都設下斷點,偵辦不易,因此,經常是上演警方投入大量的人力及物力成本,致力於偵查與破獲,但民眾損失的金錢卻要回的少。鑑此,如何運用科技與管理措施,透過政府部門(金融監督機關及警察機關)與企業部門(金融機構、超商或物流)跨域的通力合作,公私協力,一起努力在第一線攔阻詐騙發生,將更能有效守護民眾財產,這也是本研究朝金融阻詐方面著手的主要目的。
本研究採文獻探討法及深度訪談法(In-depth Interview)等方式進行資料蒐集,並以研究者、訪談同意書、訪談大綱及其他訪談工具等作為研究工具。除蒐集當前我國金融部門與警察機關等主管機關詐騙攔阻的現行規定,再透過深度訪談法,遴選金融機構的分行經理或風險管理師、攔阻詐騙實務經驗的櫃檯行員、受理詐欺案件的承辦員警或刑事偵查人員及指揮督導人員(業務主管),以及參考全國六都攔阻成效最佳「臺南市」的實務作法,了解現行警察機關與金融機構在詐騙攔阻的合作與分工的模式、實務現況、可能遭遇瓶頸與成功經驗,以及可能進步的方向等。
研究顯示,如能藉由強化金管法令要求、金融機構行員的關懷提問、警示畫面、監視影像分析車手特徵、AI 智慧分析、警察機關協助…等各項宣導及攔阻等作為,在民眾匯款前一刻阻止民眾被詐騙,不僅能即時防阻民眾的財產損失,以及減少後續警察偵辦案件所需耗費之人力與物力的社會成本,讓詐騙集團無法領取不法所得,更能遏止詐騙集團的囂張氣焰,企盼本研究的發想,能進而形成應對電信詐欺的金融管理與刑事偵防的政策。

The information age has promoted the accelerated development of the Internet society, and criminal tactics have changed with each passing day. The emerging forms of fraud in which criminals indirectly contact through telecommunications or the Internet have caused an endless stream of domestic telecommunications fraud cases and harmed people’s property. Fraud groups use all kinds of words and methods to defraud people’s property and recruit people as withdrawal person. However, no matter how many withdrawal person and fraud groups are seized by the police, the people are most concerned about whether the lost money can be recovered. However, the fraud groups are setting a break point of almost every level, which makes investigation difficult. Therefore, in such cases, the police often cost lots in investigating and uncovering them, but the lost money could be recovered is less. In view of this, how to use technology and management measures, through the cross-domain cooperation between government departments (financial supervision agencies and police agencies) and personal departments (financial institutions and convenience store) together to stop fraud on the front line . If it happens, it will be more effective to protect people’s property, which is also the main purpose of this research towards financial deterrence.
This research adopts the method of literature discussion and in-depth interview to collect data, and uses the researcher, consent, outline and other tools. In addition to collecting the current regulations on fraud prevention by financial departments, police agencies and other competent authorities, through the in-depth interview method, the selection of branch managers of financial institutions, counter staff with practical experience in blocking fraud, police officers and supervisors, as well as the practices of theTainan City, understand the current mode of cooperation and division of labor between the police agencies and the financial institutions in fraud prevention.
Research shows that if we can strengthen the financial management laws, financial institution staff’s caring questions, surveillance image analysis, AI intelligence analysis, police assistance...and other publicity on blocking actions, before people remit money. To prevent people from being defrauded can not only prevent people’s property losses immediately, but also reduce the social costs of the police’s investigations, which can also deter fraud groups. I hope that the idea of this research will lead to the formation of financial management and criminal policies to deal with telecommunications fraud..
