警察防治少年犯罪角色之研究—以警察與少年嫌疑犯的看法為例 POLICE ROLES IN PREVENTING JUVENILE DELINQENCY –THE VIEWPOINTS OF POLICE AND JUVENVILE SUSPECTS

 警察與少年嫌疑犯對警察防治少年犯罪角色之看法及差異為何?影響警察與少年嫌疑犯對警察防治少年犯罪角色之因素為何?警察在修復式正義理論中可以扮演何種適當角色?本研究運用問卷調查法,期瞭解研究對象對警察防治少年犯罪角色(包括偵查取締、預防保護、轉介通報及調解處分)之看法、差異及影響因素。少年嫌疑犯部分由研究者至台北少年觀護所100份樣本進行普測,有效回收樣本90份。員警部分則以分層隨機抽樣對台北市警察局經常處理少年犯罪行為的基層分局及少年警察隊員警210份樣本進行施測,有效回收樣本200份。
  本研究發現:(一)研究對象對警察防治少年犯罪應有角色的看法順序恰好相反,警察人員順序為「逮捕移送角色」、「轉介通報角色」、「預防保護角色」及「調解處分角色」;少年嫌疑犯順序為「調解處分角色」、「預防保護角色」、「轉介通報角色」、「逮捕移送角色」。(二)「逮捕移送角色」及「轉介通報角色」以警察人員平均同意度較高,「調解處分角色」則以少年嫌疑犯平均同意度較高。(三)研究對象對於警察防治少年犯罪角色的看法差異致產生角色衝突。(四)警察與少年嫌疑犯均認為少年觸法肇因於環境因素更甚於個人因素。(五)警察人員視獎懲績分制度重要者、男性、年齡愈大者、無社工等專業訓練背景者,愈同意警察使用逮捕移送的角色。(六)少年嫌疑犯有尊敬警察者、未移送法院者、未認為警察易貼人標籤者、女生、年齡愈大者、居住臺北市以外之縣市者,愈同意警察使用逮捕移送的角色。
  為有效防治少年犯罪,警察對於「轉介通報角色」、「預防保護角色」及「調解處分角色」等「非逮捕移送角色」仍需重視,建議改變警察的認知,並實施以下相關配套措施,以解決警察角色衝突現象:(一)修改相關法令,賦予警察機關分局長以上長官少年犯罪微罪處理權。(二)參考紐、澳、美、加、日等先進國家防治少年犯罪的經驗與做法。(三)加強警察機關對犯罪被害人的協助與重視。(四)加強警察機關與運作良好鄉鎮市調解委員會的聯繫與轉介。(五)警察職前訓練及在職進修增列犯罪防治、心理、輔導、社工等專業課程。(六)合理建立警察防治少年犯罪獎懲績分制度,並適度增加「非逮捕移送角色」的比重。(七)充分結合政府相關部門、學校、社區資源共同防治少年犯罪的發生。(八)因應民主社會發展的趨勢,隨時調整合適的的警察防治少年犯罪之角色。

What are suitable roles for the police to play within restorative justice? This present study attempts to explore the police ideal role in preventing juvenile delinquency and also aims to examine the problems between the police and juvenile suspects . The research uses the survey method; surveying a random sample of 200 police of Taipei City Police Department and juveniles (N= 90) between ages 12 and 18 in the Taipei Juvenile Detention House .
  
  This study found that:(1)the order of thought between the police and the juvenile suspects is different.(2)The police prioritise the detection role; while juvenile suspects would prefer that the police adopt a greater restorative role .(3)There is therefore role conflict(4)The police and juveniles both think that juvenile misbehaviour is the result of more being determined by environment than personal choices. (5)The police who are male, older, and with no social work training emphasizes the traditional detection role .(6)The juvenile suspects who are female and older appear to respect police, and disagree that the police label easily; whereas those living outside Taipei city prefer the detection role .

  In order to prevent juvenile delinquency, the study suggests the following: (1)changing the law in order that the local branch police department chief has the right to manage misdemeanours . (2)To collate the experience and methods of preventing juvenile delinquency in New Zealand ,Australia ,United States, Canada and Japan.(3)That the police department pay more attention to compensation of victims.(4)The police department pay more attention to referring juveniles for restorative justice(5)The police department provide more on the job training in ‘social work issues’ for all police officers.(6)The police department produce an appropriate balance between traditional approaches of detection and punishment alongside restorative justice(7)To develop a multi-agency approach to preventing juvenile delinquency.(8)To provide a suitable police role in an emerging democracy.
