少年矯正教育現況與改革:以感化教育、刑事處分少年學籍轉銜與復學政策為聚焦

我國少年矯正教育近幾年因矯正學校成立,再加上人權議題重視,各種少年矯正相關法規與制度不斷修正下,成為亞洲國家中少年矯正制度相當有特色國家之一。雖我國少年矯正教育已具規模,特於少年矯正學校之設置使得我國少年矯正教育充滿教育色彩與保護之特色。惟現階段之少年矯正教育當中,仍有部分重要議題,例如學籍轉銜與復學政策之現況與未來改革方向為我國於少年矯正教育改革波潮下,一個易被忽略卻於維護少年成長之宗旨下亟需重視之問題,此突顯本文研究之契機與重要性。承此,本文主要聚焦於學籍轉銜與復學政策之議題,擬以文獻探討與焦點團體等研究方法,針對學籍轉銜與復學政策之現況進行分析,並一併觸及我國近期針對少年收容處遇相關法規改革提出新之視點與改革建議。

 

英文摘要:

 

In recent years, due to the establishment of additional correctional schools and the increasing importance being given to human rights issues, as well as a series of amendments to various correctional education laws and regulations, Taiwan’s correctional education system has become one of the most distinctive in Asia. While still focusing on juvenile reform, Taiwan’s extensive juvenile correction system now focuses on education and protection. However, there are still some important issues which need to be addressed at this stage. For example, the recent wave of reform has given little attention to the current and future policies on student transfers and re-enrollment. This easily overlooked but very important area is the topic investigated in this paper. Using data gathered through document analysis and focus-group interviews, I investigate the current situation of transfer and reenrollment at correctional schools, and also present some new perspectives and offer a number of suggestions for future reforms of Taiwan's correctional education system.
