我國青少年感化教育安置輔導執行成效之研究—以彰化兒童學苑為例 The Study of Practice on Education and Residential Placement for Delinquency Juvenile in Taiwan- The Case of Changhua Children’s Academy

本文的研究背景或動機至少來自以下四項:一、時空變遷下的少年感化教育;二、少年感化教育法律制度的進程;三、少年感化教育管理的挑戰;四、少年感化教育執行策略之差異。據此提出以下四項研究標的:一、理解少年感化教育的深層意義;二、理解法律制度對少年感化教育的重要性;三、理解少年感化教育的管理作為;四、理解彰化兒童學苑執行作為的差異。為了達成上述研究目的,對照提出以下四項研究問題:一、彰化兒童學苑的發展歷程為何?;二、法律制度如何影響彰化兒童學苑的作為?三、彰化兒童學苑內部管理的要素為何?四、彰化兒童學苑在少年感化教育上作為的模式與選項是什麼?
本文的研究方法,主要採納個案研究的方法—即彰化兒童學苑對非行兒少安置輔導之執行策略的個案選取和研究,並以現有著作文獻與訪談資料等次級資料為研究分析的來源。而本文的策略作為研究架構,係以SWOT分析框架,這是一種企業組織策略作為的基礎分析方法之一,透過評價自身的優勢(Strengths, S)、劣勢(Weaknesses, W)、外部競爭上的機會(Opportunities, O)和威脅(Threats, T),用以在制定企業策略作為的選擇,這些策略作為的選擇結果,至少包括,第(一)象限的「積極—積極」作為、第(二)象限的「消極—積極」作為、第(三)象限的「消極—消極」作為、第(四)象限的「積極—消極」作為等四項執行策略。至於影響策略作為的內外部要項,則以「相關行為者」、「結構環境」與「報酬利益」,做為檢證分析的自變項。
透過彰化兒童學苑個案分析後,發現彰化兒童學苑在2001至2006年時期策略選擇為第四項象限的「積極—消極」作為;2006至2015年時期策略選擇為第三項象限的「消極—消極」作為;20015至2017年時期策略選擇,則再回到第四項象限的「積極—消極」作為。綜整本文主要研究發現與成果,包括:一、發現我國少年感化教育的發展趨勢;二、理解法律制度對少年感化教育影響的重要性;三、理解彰化兒童學苑內部管理的作為;四、發現彰化兒童學苑執行策略的選擇和變化。

英文摘要:

The thesis is inspired by the following at least four background factors or motives, 1.the transition of reform education and residential placement for delinquency juvenile, 2.the progress of law for reform education in delinquency juvenile, 3.the challenge of management for reform education in delinquency juvenile, and 4.the difference in practice strategy for reform education in delinquency juvenile. The aims of this thesis are 1.understanding the deep meaning of reform education in delinquency juvenile, 2.understanding the significance of law to reform education in delinquency juvenile, 3.understanding the management reform education in delinquency juvenile, and 4.understanding the difference of practice strategy by Changhua Children’s Academy. Moreover, in order to achieve the purposes of this study, we try to address the following for questions: 1.what is development of Changhua Children’s Academy? 2.how did the law affect to Changhua Children’s Academy? 3.what are the factors of Changhua Children’s Academy manage to delinquency juvenile? and 4.what are the model and choice of reform education for Changhua Children’s Academy?
The method of thesis is a case study approaches which Changhua Children’s Academy will be chose. The analysis literature of this case study will come from secondary information of interview words. The analysis framework of this thesis is the SWOT framework which is a fundamental analysis of practice strategy to organizations. Through the factors of strength, weakness, opportunity, and threat, the choice of practice strategies are 1.active-active actions (Ⅰ quadrant), 2.passive-active actions (Ⅱ quadrant), 3.passive-passive actions (Ⅲ quadrant), and 4.active-passive actions (Ⅳ quadrant). The variables of those practice strategies in external and internal are player, structure, and payoffs.
After the empirical analysis of Changhua Children’s Academy, we infer the followings: 1.the practice strategy is active-passive actions (Ⅳ quadrant) in the period of 2001-2006; 2.the practice strategy is passive-passive actions (Ⅲ quadrant) in the period of 2006-2015; 3.the practice strategy is active-passive actions (Ⅳ quadrant) in the period of 2015-2017. Finally, the research contribution are as followings: 1.finding the progress and developing of reform education for delinquency juvenile in Taiwan, 2.understanding the significance of law to reform education in delinquency juvenile, 3.understanding the internal management of Changhua Children’s Academy reform education in delinquency juvenile, as well as 4.finding the choice and difference of practice strategy for Changhua Children’s Academy.
