網路科技的即時性和匿名性，也成為犯罪者覬覦的新領域，網路身分竊盜是當前較為嚴重且難以防範的電腦網路犯罪行為之一，常見的手法為「網路釣魚」（Phishing）。網路釣魚基本上係以竊取個人身分資訊之意圖，以合法或合理的表徵或理由為外觀，透過網頁、電子郵件、即時通訊等網路通訊方式，誘使或要求個人提供身分資訊，如信用卡號碼、使用者名稱或密碼等。2008年美國參議院提出「反釣魚消費者保護法草案」，處罰在電子郵件、網頁或其他網路通訊方式中，以欺騙或誤導性陳述，詐騙取得個人資訊。由於釣魚行為在我國是否直接抵觸刑法及個資法仍有疑義，故本研究建議參考美國釣魚立法之規範要件，起草我國網路釣魚的刑事規範。 

English Abstract

Phishing is an Internet scam in which criminals design e-mails and websites that appear to originate from a legitimate business, government agency, or financial institution and then use this false identity to deceive Internet users into disclosing personal financial information. The United States has adopted legislation to combat with increasing phishing activities. ’Anti-phishing Act’ has been proposed in the U.S. Senate three times since 2004. Twenty states have passed specific legislation on phishing.
