更生保護人的就業促進之探討-以桃園縣為例<P>The research protection of employment promotion of the rehabilitated-Take Taoyuan County as an Example.

依法務部統計資料顯示,近年來新入監人數雖迭有增減,而新入監的收容人數91年時為27,003人至100年則為36,459人,其再累犯所占比率高達約七成,顯見社會治安狀況仍未轉好之情形。受刑人入監前教育程度高中職學歷以下所占比例約有八成之多,職業則以技術工體力工、無業者比例占多數,這些人離開矯治場所復歸社會時,因長期與社會脫離,習於矯治場所的制式化生活且原本之工作技巧替代性亦高,而「出獄人」在主流文化價值底下社會對他們是受到社會排除、污名化、標籤化的一群,致使他們因社會心理面、工作態度、工作習性及技能上的障礙,在復歸社會進入勞動就業市場覓得一職的過程要比一般人困難許多。 本文試圖探討現行更生保護人就業的困境及執行的困難點,研究將特別聚焦於更生受保護人穩定就業的歷程、及就業輔導人員輔導處遇及開拓雇主的作法與瓶頸,並採質性研究方法以深度訪談,立意取樣的方式進行選樣,對更生人、就業輔導員、雇主及專家學者進行訪談,研究發現:更生人復歸社會,標籤化與社會排除是更生人復歸社會的主要障礙,去除人際關係的排除及社會資源的排除對更生人是很大的鼓勵;而更生人因為自身人力資本的不足,故需喚起更生人本身的自我意識促使其求知向上、增進技能,則對更生人的就業有非常大的幫助;並發現社會支持是更生人穩定就業、復歸社會最主要的助力。因此本文藉由研究結論對政策、更生保護會、就業服務措施、更生人及其家庭提出建議,目的希望能提升更生人的就業穩定、預防再犯、降低社會成本。

According to statistics by Ministry of Justice, it showed that although the number of new entrants to the prison changes in recent years, while the number of new entrants to the prison amounted to 27,003 people in 2,002 compared with 36,459 people in 2,010.The recidivism rate was as high as about 70%, which showed the situation of social Security has not turned better. About 80% of the level of education of People who are executed lied in the high school level of education, and majority of them are technical worker, Labors by occupation. Because of long-term social detachment, being used to learning correction of regularization in place of the original work and their highly replaced working skills, and under the mainstream cultural values of their society which were subject to social exclusion, stigmatization ,it was much more difficult for them than the average persons to find jobs in the employment process for social reintegration due to psychosocial terms, work attitudes, work habits and skills barriers. This paper attempted to explore the current plight of the employment of rehabilitated protection and the difficulty in enforcement, and this research particularly focused on the stable employment process of the rehabilitated, career guidance given by counselors at the employer's practices and bottlenecks on exploring opportunities. We also had depth interviews with the rehabilitated, employment counselors, employers and experts using qualitative research methods, purposive sampling approach to sampling. The study had found that labeling and social exclusion had became the rehabilitated’s major obstacles when they wanted to go back into society.
