毒品問題自清朝鴉片問題以迄今日，已百餘年困擾著國人，近年來毒品問題，已成為嚴重之社會問題，尤其因施用毒品入罪化，施用毒品者必須躲在幽暗處而相立間共用毒品，感染愛滋病或其他疫情問題，日趨嚴重。目前我國施用毒品之刑事政策，是在刑事司法與公共衛生的交錯矛盾中，而施用毒品者在「治療勝於處罰」原則中向處罰斜傾，以致施用毒品而引發之相關連犯罪與愛滋病問題，達到不容忽視之程度，施用毒品已非單純刑事犯罪問題，而是為嚴重之社會問題及公共衛生問題，社會是否應以寬容態度對待施用毒品者，並選擇以人道並符合絕大多數人民避免遭受疾病感染的施用毒品新刑事政策與作法？是否應將施用毒品者單純視為病人，以醫療方式解決施用毒品問題，走向除罪化的做法，對施用毒品者不加刑罰，將無須以刑事司法的手段加以控制的施用毒品自傷行為模式，改由具有行政或社會性質的社會控制機構負責，施用毒品行為除罪化與不加刑罰化，並不是國家放任或寬恕或是對施用毒品行為不加以處理，而是應由政府以一套「謹慎開放，有效管理」而可行的管制施用毒品政策，由國家衛生醫療機構以減少傷害及醫療治療政策全面接手；而司法機關則退出施用毒品行為之處理，卯足全力嚴格追訴提供毒品之製造、運輸、販賣及轉讓毒品者之刑罰，如此毒品之需求既已減少，而毒品之供給亦將被有效斷絕。民國一百年了，是抗制毒品問題在施用毒品範疇內選擇正確道路的時候了。

      From the Qing dynasty, the drug has bothered our society more and more seriously, especially after its criminalization. While drug abusers have to help each other to take drugs in secret, AIDS as well as other infectious diseases result in serious epidemic problems. The current drug policy interlaces the criminal justice system with the sanitation system. Since the idea of criminal treatment for drug issues prevails, AIDS and other infectious disease become an important concern which could not be ignored. To some extent, drug issues are not criminal problems only. Drug issues include sanitation also. Whether the society should treat drug abusers kindly and tries to avoid itself from infectious diseases, whether the society should treat drug abusers like patients instead of criminal offenders, and whether the society should decriminalize drug-taking seem to be under consideration. Drug abusers should not be sent to the criminal justice system if the sanitation system would provide better treatments. The criminal justice system should only be involved in other drug issues, such as manufacture, transportation, sale, and assignment of drugs. If drug supply becomes less, drug abusers will reduce accordingly. It is time for our society to choose a right direction to deal with drug abusers.
