過去我國常有許多假釋受刑人於假釋出獄後，於一年內甚至半年內又再犯重大惡性之罪，嚴重危害社會治安，引起國人之質疑和責難，足見假釋制度設計之良窳及其執行之是否確實，不僅攸關假釋目的能否達成，且與社會安全息息相關。我國最新刑法修正（民國九十四年）雖係採「寬嚴並進」的刑事政策，唯在假釋規定部分則為「嚴格」刑事政策，主要目的就在提高「假釋門檻」，藉加重受刑人獲得假釋之實質難度，以回應近年來社會大眾對治安惡化之不滿。雖然刑法之假釋規定業已重新修正，但應如何建構優質之假釋制度，並發揮監獄教化、輔導之功能，以及落實對受刑人公平、公正和客觀之考核，但又能對犯重罪之受刑人從嚴審查而不會產生爭議，並強化保護管束、更生保護等機制，力求與監獄矯治之連結，藉整合社會資源，暢通、完備相關網絡與措施，促進受刑人未來復歸社會之可能性與實效性等，均是當前政府辦理假釋必須重視之處。茲為增進假釋制度之功效，本文特提出「積極規劃健全社區處遇相關配套措施」、「調整假釋核准機關改採獨立委員會模式」，以及「對可能再犯受刑人採嚴格審查並落實監控機制」等策進方向，供政府未來在執行政策方面或繼續修法方向之參考。

English Abstract

In the past, many prisoners have committed serious crime again within one year or even half a year after being discharged through parole. These serious criminal events critically affected social security, so parole has also been questioned and blamed by the general public. From this aspect, we found that the design and enforcement of parole systems are closely associated with its purpose accomplished and social security maintained. The alter geared toward raising ”Parole Threshold” has deemed as a considerable event in the latest modification of Criminal Law in Taiwan, because it will increase the substantial difficulty of condition to grant parole to inmates serving prison sentence, and also as a response to pressure from most people who feel anxious about their lives and properties. In spite that the modification on parole regulations has been passed, it is important to know how we can construct an effective parole system and keep prison education and guidance operating efficiently. How to make fair, just and objective observations on inmates in correction systems and restrict screening at decision-making process to grant or deny parole especially to inmates that committed felony without any dispute? We should strengthen the mechanism of probation, incorporate social resources, connect related networks and measures, and promote the possibility and effectiveness of inmates after release to reintegrate them back into society. The authority should notice and make feasible policy to deal with the preceding problems. It is also the major studying points of this essay.
