臺灣歷經中國國民黨長達四十餘年的威權體制統治後宣布解嚴，逐漸開啟了民主運動新的一頁，雖然臺灣為民主政治，可是在這樣現代化的社會依然卻存在仇恨和對立，如果與外國的民主社會比較起來，臺灣仍然有許多要再進步的地方，也讓筆者決定想研究臺灣民主的演變，透過論文的探究、分析、建議，並期許對臺灣的民主能進一分棉薄之力。
本論文以《促進轉型正義條例》為主軸，架構式的介紹立法目的，並將條例的任務，開放政治檔案、清除威權象徵、保存不義遺址、平復司法不法、還原真相、促進社會和解、處理不當黨產等其他轉型正義事項細部的加以歸納與整理分析，廣納蒐集國內學者之文章與媒體網路資料，將資料整理之後再與過往歷史進行一個串連，筆者認為轉型正義跟歷史學、政治學、法律學是緊緊相扣的。
面對此項工程是一件浩大的工程，為了民主的進步和改革是不能停滯的，過去的統治集團在人民生命、身體、財產上造成的傷口，此時轉型正義就是撫平受害者傷痛的良藥，處理威權體制所造成的不法是現代民主國家必做的任務。

英文摘要：

After KMT’s government of authoritarian for more than 40 years, the Martial Law was abolished finally, and then Taiwan gradually opened the new page in democratic campaigns. Although Taiwan now is a democracy, hatred and opposition still exist in many aspects of society. Compared with other democratic countries, Taiwan still has much to be improved. Therefore, author decided to research the developing process of Taiwan’s democracy. By discussions, analysis and suggestions in the paper, hope can do our bit for Taiwan’s democratic development.
Using Promoting Transitional as the main axle, including widely arranged domestic scholars’ articles, media and internet data, and then associates them with history,
the paper introduces the purpose of legislation, and generalizes, arranges and analyzes the issues such as the purpose of ordinance, revealing the political files, clearing the symbols of Authoritarian, preserving the monuments of injustice, remedies for miscarriage of justice, returning the truth, advancing the reconciliation of society, settling the ill-gotten party assets and other issues related transitional justice. Author thinks transitional justice is closely linked with history, politics and law.
Although this is a tremendous work, for progress of democracy, the reformation can’t be stagnated. Transitional justice is the appropriate remedy for injuries to people’s life, bodies and properties caused by past government, so for modern democratic countries, settling the injustice caused by authoritarian is an essential mission.
